These Terms of Service ("Terms") govern your access to and use of the Icon website at https://iconpolls.com ("the Platform"), including all features, services, content, and functionality offered through the Platform. The Platform is operated by Icon ("we", "us", or "our").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Platform.
1. About the Platform
Icon is a global ranking and fan voting platform. We host community-driven rankings across entertainment, lifestyle, sports, technology, culture, and other categories. Users can browse rankings, vote for nominees, post comments, read articles, and on select rankings, purchase charity voting tickets. Rankings are determined by user votes and are not editorially manipulated or sold.
2. Eligibility
You must be at least 13 years old to use the Platform. If you are under 18, you must have the permission of a parent or legal guardian to use the Platform and to make any purchases, including charity voting tickets. By using the Platform, you represent that you meet these age requirements.
We reserve the right to refuse service, terminate accounts, or restrict access at our sole discretion if we believe a user does not meet the eligibility requirements or is using the Platform in violation of these Terms.
3. User Accounts
Certain features of the Platform require you to sign in through a third-party authentication provider such as Google. When you create an account:
- You agree to provide accurate information and to keep your account credentials secure.
- You are responsible for all activity that occurs under your account.
- You agree not to share your account with others or allow others to access it.
- You agree not to create multiple accounts for the purpose of manipulating votes, circumventing bans, or any other purpose that violates these Terms.

4. Voting
4.1 Free Voting
Most rankings on the Platform allow free voting. Free votes are subject to rate limits, IP-based controls, and captcha verification to maintain vote integrity. Each user is expected to vote honestly and in good faith. The following activities are prohibited:
- Using bots, scripts, browser extensions, or other automated tools to cast votes.
- Using VPNs, proxies, or other tools to circumvent voting limits or cast multiple votes beyond what is permitted.
- Coordinating organized vote manipulation campaigns, including paying or incentivizing others to vote in a specific way through external platforms.
- Exploiting bugs or vulnerabilities in the voting system.
We reserve the right to invalidate votes, suspend accounts, and take other corrective action if we detect voting manipulation.
4.2 Charity Voting Tickets
On select rankings designated as charity polls, users can purchase voting tickets with real money. Tickets allow you to cast additional votes for nominees. Here are the terms governing ticket purchases:
- Payment processing: All payments are handled by Stripe. We do not store your credit card details. By making a purchase, you also agree to Stripe's Terms of Service.
- Ticket scope: Tickets are purchased for a specific poll and can only be used on that poll. Tickets are not transferable between polls, between users, or redeemable for cash.
- Ticket expiration: Tickets do not expire as long as the associated poll remains active on the Platform. If a poll is removed or archived, any unused tickets for that poll will be forfeited unless we offer a refund at our discretion.
- Pricing: Ticket prices are displayed at the time of purchase and may vary between polls. Prices are shown in the currency configured for the Platform and include all applicable fees.
- Charitable allocation: A portion of ticket purchase revenue is allocated to charitable causes as described on the relevant poll page. The specific percentage and recipient charity are determined by Icon and may vary by campaign.
4.3 Refund Policy
Because voting tickets are digital goods that are consumed upon use, refunds are handled on a case-by-case basis. You may be eligible for a refund if:
- You were charged but tickets were not credited to your account due to a technical error.
- A poll was removed from the Platform before you had a reasonable opportunity to use your purchased tickets.
- You were charged multiple times for the same purchase due to a payment processing error.
To request a refund, email [email protected] within 30 days of the purchase with your account email and details of the transaction. We will review your request and respond within 14 business days. Approved refunds will be issued to the original payment method.
Refunds will generally not be granted for tickets that have already been used to cast votes, for buyer's remorse, or for dissatisfaction with ranking results.
5. User-Generated Content
The Platform allows you to post comments on rankings and blog articles ("User Content"). When you post User Content:
- You retain ownership of your content, but you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Platform.
- You represent that your content does not infringe the intellectual property rights of any third party.
- You agree that your content complies with our content guidelines as described in Section 6.
We reserve the right to remove any User Content at any time, for any reason, without prior notice. We are not obligated to host, display, or distribute any User Content and may remove it at our sole discretion.
6. Content Guidelines
You agree not to post content that:
- Contains hate speech, threats of violence, harassment, or discrimination based on race, ethnicity, gender, sexual orientation, religion, disability, or any other protected characteristic.
- Is sexually explicit, pornographic, or depicts minors in any inappropriate context.
- Contains death threats, encourages self-harm, or dehumanizes individuals or groups.
- Is defamatory, knowingly false, or intended to mislead.
- Contains spam, unsolicited advertising, phishing attempts, or malicious links.
- Impersonates another person, organization, or entity.
- Contains personal information of others without their consent, including phone numbers, addresses, or private photos.
- Infringes on copyrights, trademarks, or other intellectual property rights.
We use a combination of automated content filtering and human moderation to enforce these guidelines. Violations may result in content removal, temporary restrictions, or permanent account suspension depending on the severity.
7. Intellectual Property
The Platform, including its design, code, features, logos, text, graphics, and other content created by us (excluding User Content), is our property and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.
The names, images, and likenesses of nominees featured in rankings are used for informational and editorial purposes. Icon does not claim ownership of third-party trademarks, brand names, or celebrity likenesses. If you believe your intellectual property rights have been infringed on our Platform, please contact us at [email protected] with details of the alleged infringement.
8. Ranking Integrity
Rankings on Icon are determined by user votes. We do not accept payment in exchange for ranking positions or favorable placement of nominees. Our revenue comes from advertising and charity voting ticket sales, not from nominees, brands, or their representatives paying for rankings.
We reserve the right to adjust, merge, split, or remove rankings at any time based on editorial judgment, community feedback, or content policy considerations. We may also add or remove nominees from rankings. These editorial decisions are made to maintain the quality and relevance of the Platform and do not constitute vote manipulation.
9. Advertising
The Platform displays advertisements from third-party advertising networks, including Google AdSense and other partners. These advertisements may use cookies and similar technologies as described in our Privacy Policy. Ad content is provided by third parties and does not represent the views or endorsements of Icon.
We make reasonable efforts to ensure that advertisements displayed on the Platform are appropriate, but we do not have full control over which specific ads are shown by our advertising partners. If you see an ad that you believe is inappropriate, misleading, or offensive, please let us know.
10. Third-Party Links and Services
The Platform may contain links to third-party websites, applications, or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. Accessing third-party links is at your own risk, and we encourage you to review their terms and privacy policies.
11. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content, rankings, or vote counts displayed on the Platform.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Icon, its operators, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. This includes, but is not limited to, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from your use of the Platform shall not exceed the total amount you have paid to us in the 12 months preceding the claim, or $100, whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless Icon, its operators, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your User Content, your violation of these Terms, or your violation of any rights of another person or entity.
14. Account Termination
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we need to do so for legal, security, or operational reasons. Upon termination:
- Your right to access the Platform will cease immediately.
- Any unused charity voting tickets in your account will be forfeited unless we determine a refund is warranted.
- Your User Content may be retained or deleted at our discretion.
- Provisions of these Terms that by their nature should survive termination will continue to apply, including Sections 7, 11, 12, 13, and 16.

15. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we may provide additional notice through the Platform. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
If you disagree with any changes, your remedy is to stop using the Platform and, if desired, request deletion of your account.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Icon regarding your use of the Platform. These Terms supersede any prior agreements or understandings, whether written or oral.
